By downloading, installing, purchasing, or using any Monakai Audio product, you agree to be bound by these Terms. If you do not agree, please do not use our Site or products.
Upon purchase or authorized download, Monakai Audio grants you a limited, non-exclusive, non-transferable, royalty-free license to use the digital product(s) for both personal and commercial music production, sound design, live performance, and educational purposes. This license is granted to you personally or to the entity on whose behalf the purchase was made.
You may install and use our plugins and sample content on any computers that you personally own or control. You may use our products to create original musical works, recordings, and productions, and you may distribute, sell, or publicly perform those works without paying additional royalties to Monakai Audio.
You may not resell, redistribute, sublicense, rent, lease, or otherwise transfer the products or any license keys to third parties. You may not reverse engineer, decompile, disassemble, modify, create derivative works from, or attempt to derive the source code of any Monakai Audio software. You may not remove or alter any copyright, trademark, or proprietary notices included with the products.
All content on the Site, including but not limited to software, logos, trademarks, text, images, audio demonstrations, and product designs, is the property of Monakai Audio or its licensors and is protected by copyright, trademark, and other intellectual property laws. The purchase of a product does not transfer ownership of any intellectual property rights.
Because our products are digital and available for immediate download, all sales are generally final once a download link or license key has been delivered. We encourage you to use free trials and demo versions before purchasing. If you experience a technical defect that prevents the product from functioning as described, contact us within 14 days of purchase and we will work to resolve the issue or provide a refund at our discretion.
If you create an account on our Site, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate your license and access to our Site and products if you violate these Terms. Upon termination, you must cease all use of the products and destroy any copies in your possession.
Monakai Audio products are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the products will be error-free, uninterrupted, or compatible with every system configuration. It is your responsibility to verify compatibility with your DAW, operating system, and hardware before purchase.
To the fullest extent permitted by law, Monakai Audio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site or products, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the product giving rise to the claim.
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Los Angeles County, California.
We may update these Terms from time to time. The most current version will be posted on this page with an updated “Last updated” date. Your continued use of the Site or products after any changes constitutes acceptance of the revised Terms.
